I was late.
This is a Daubert hearing, it is to qualify an expert witness in court to let them testify. No jury is in the room (Thanks Harlette)

How awkward is this?

Jodi is sitting in the juror box. Travis' family is behind her.



Brian Neuimeister is on the witness stand.

I like it when the lights are down low.

They moved Jodi somewhere else. Brian is now talking about his experience. They have Travis' shower photo up on the screen. They are talking about camera stuff. (I have no idea what is going on) (I think Nurmi is fixing to bring up that there might be somebody's in Travis' eye)

JM is up

How many times have you testified? A dozen in Maricopa.
He only enhanced the audio in this Jodi case, not pictures. JM says the motivation for testifying before was to be "qualified" in this area.

Approach

The last time Brian testified was for Juan's office on another case (LOL) He's just been retained by Juan's office again for another case coming up. He's also testified about videos.

I don't know who this dude was...
but he sure thought Nurmi was funny!

He enlarged Travis' eye. He drew some lines EX 4. Do you see better than anybody else who has 20/20 vision? No

JM pulls out EX 3 without the lines.
Isn't it true we could show it to other people, and they could disagree with you? Correct.
Isn't there a test, like a cancer test, where we could see how you got the lines? Good equipment.

These fake glasses are really bugging the hell out of me.

Nurmi is back up

Nurmi is showing EX 4 and talking about how the lab has better equipment to see the "person" in the eyeball.
Brian says that you can not see the person, and you can't identify the person in the eyeball.

Brian steps down.

Now the attorneys argue.

I never thought I would be arguing over an eyeball picture.

JM says he seen a dog in the eyeball with floppy ears and a stick. (HAHAHAHA)
Now Nurmi is saying the state is withholding evidence. Nurmi thinks JM has a skewed view. Nurmi is now talking about the Doc. JM is going to bring up. Nurmi wants to bring the jury to the lab.
Nurmi thinks this picture proves Jodi was telling the truth (Huh)

Nurmi is so hot. I wonder if he's Mormon??

JM says he sees a German Shepherd. Woof

Misconduct motion

Nurmi wants to play something for the court. Nurmi says he did not intimate witnesses.

We are so tried of the drama queen. Is it wrong that we wouldn't
be hurt if she drank battery acid tonight?

JM objects b/c it has nothing to do with signing of autographs.

Nurmi says they are all one in the same. I guess Nurmi is saying JM is mean to witnesses in chambers, and he wants to play it.

JM wants  ruling on what Ms Wong testified to.

Nurmi says it's all cumulative. Nurmi is mad b/c JM has a fan club. Nurmi says JM is "The great one"
JM says Nurmi is to worried about the social media does. JM says the defense is grandstanding, and they want to piggyback other stuff on it. JM is saying Nurmi is wasting time. JM says the defense just wants to add more pennies to their bill.

Judge is ruling. Mistrial denied.

Nurmi is now bringing up stuff JM did to Alyce is closed chambers. Nurmi is fixing to play something. They are playing an audio of JM with Dr. Sameuls. (Jesus Christ-not the dr. again) Dr said that Jodi was depressed. (Sorry, I'm not hearing anything that JM says that is mean) (So far it all sounds like BS)

That "doc" is just butt hurt at me He's a fraud.

Now an oral argument between Nurmi and JM.

EX 1 was admitted in. Nurmi is going on about how mean JM is to doc. Nurmi thinks he's a bully.

JM is talking now. JM says Alyce should be upset based on what was recovered. JM says there is an ethical problem with the defense attorneys. JM says Doc was evasive. JM says Doc was a failure. JM says he is not responsible for any media stuff. JM is bringing up how Jodi is tweeting and how she violates the courts rules. State wants to court to make her stop. JM brings up how Jodi talks about him on twitter.

We are the legal team..up shit creek without a paddle.

Nurmi calls it a shell game.( Nurmi hasn't bought up if the twitter account is actually Jodi's) Nurmi thinks JM has disrespected the doc for not calling him doc.

Judge- state's conduct-no evidence- denied. Judge finds that JM was not in any way outside the bounds.

Twitter account- Nurmi says she has freedom of speech rights. Nurmi thinks JM needs to provide evidence.
JM- JM is just bringing it to the court's attention. Judge says she is not going to take any action. She says it can go through the sheriff's office.


There is a 1:15 sealed court with Alyce today.

Recess until 1:15

They come back around 3:15 after a very long delay

The jury enters

The judge says:
Jodi was not holding a knife or gun in her hands when EX 159 was taken. Both state and defense agree.

Court is finished for the day. 9:30 am tomorrow.

I knew it was going to be a bad day when we didn't match.
