3/25/13 Day 37- The Dr is still up. He needs a Dr.

Morning
Jodi is wearing a white top. (wildabouttrial on twitter says that the attorneys are in chambers) Jodi's bangs are longer, so they blend in with hair now. Looks like she got a good hair wash over the weekend.

Dr. Samuels is back on the stand today. JM is up for the state.




Scoring- EX 535-  It's a score sheet. He did a retest on this twice. JM wants to know when he created this?

EX 534- says Jan 15, 2010. He's not really sure, it could have been 6 months later. EX 550- This was a rescore test. EX 535- something was missing. The dr's original worksheet was missing. (I'm not sure what this proves other than the dr doesn't keep good paperwork and he his messy with paperwork)
Did you have 550 and 534 in your hands when you rescored? I'm not sure.
Why are you rescoring the stuff without the raw data? uh, you don't have to.

The dr. just blamed JM for all the papers being screwed up.
This dr. can't even give specific dates on any of his paperwork.  The dr. is saying that the paper was not meant to be disclosed.
The dr. doesn't know how to add up his numbers either b/c the paperwork math is off on all 3 pages. One score was 15, and one was 17.



Wilmont got up to object, then JM said he objects to the speaking objection-then the judge gets on to the defense.

EX 553- the dr. says it's not his printout. JM said it was a document submitted to the state.

Defense asks for an approach
JM is reading off the signs a person must have to classify them as PTSD.

Her outbursts of anger towards her mother had been present since her teen years? Yes, to a lesser degree. JM wants to talk about it. JM wants to show 3 EX, but Palin wants a sidebar quick!

EX 554- EX 555- EX 556-  (they have to approach again), but I think these are diary entries of Jodi's.
Didn't Jodi treat her mother like crap? Yes
Jodi would hit her mom? Yes
We are not mad Jodi is locked up.
It's the first time in years the family has felt

During the move and Sandy came to help Jodi. Jodi yelled at her mother. Jodi and her mother never got along. The phone calls between Sandy and Jodi- nobody heard the calls. Your going to disregard real stories only to believe Jodi's story of the phone calls? We talked about it.

This was JM's writings in court on the
PTSD.


Did Jodi kick Sandy for no reason while they were eating dinner before? Yes (Folks, I hate to diss somebody but this dr. is a quack. He may have plenty of experience, but he was so wrong with Jodi.)

Hard time focusing- Dr. found that was wrong with Jodi. (still, he just listens to what Jodi says) and JM said "give me one example" and the dr. said she was having problems reading. JM brings up Jodi saying that she read the whole book of Mormon cover to cover. (HAHAHA) Now the dr. is yelling and banging on the stand. JM bangs on the stand. (That was a GREAT MOMENT)

JM wants the dr. to give him another area. Dr. says Jodi can not relax (are you fucking kidding me)

Hyper aware-
JM: Couldn't you say it could be caused it somebody is paranoid or felt people were snooping? Dr. again says jail was rough on her.

JM: Do you remember saying at an interview with me, you said Jodi had no problems sleeping? I don't remember. JM: well, lets play it then (so far, Palin has been successful in blocking all of the stuff JM has tried to get in today)

EX 557- the interview between Dr and JM. He said Jodi didn't have any problems sleeping.
Jodi felt her personal space was invaded in jail. The lights at jail are too bright. (no, I am not kidding) (I guess you can get PTSD if you go to jail)
The dr still says she has PTSD.

Another section C- You have to get 3 out of 7, but he found 5 for Jodi. #7 is a sense of a shorten future. Jodi made statements about suicide.
Here was Jodi's suicide diary entry:

 8-26-07-I just wish I could die. I wish that suicide was a way out. But it is no escape. I wouldn't feel anymore pain though if I could just stop existing and have my consciousness dissolved into nothingness, and my energy recycled into something else useful, for I am of little use to the world right now, through no fault (but) my own.


That's not a new thing for her, right? She though of it before. (One of the requirements is these systems must NOT be present before the trauma.)

She told Matt she was going to kill herself. She has said it many times. Jodi has never been on suicide watch in jail. She didn't tell the dr if she took steps to do it.

They actually believe that?
I am way too hot to kill myself. Plus it hurts

C6- Unable to have loving feelings- Dr says Jodi had this. Jodi did not have emotions. The dr said he seen the police interviews-and Jodi was laughing during some of the interviews.

Are you talking about somebody killing somebody or the one that had a loved one die? It's not important. Dr. also seen the WHOLE video of 48 hours. Jodi is smiling during certain parts. Jodi created an alternate universe.

Is it true 2 people killed Travis? No
Jodi is a better liar? I wouldn't say she's a liar. It shields her which is why she does it.


JM tells the dr. not to talk about stuff that doesn't apply to this case when the dr. was talking about MPD.

Jodi would laugh with her family on the phones when she called them.
#5- Detachments from others- Jodi was tuned out. Foggy brain.
What "others" did she feel detached from? The inmates. (HAHAHA)
Jodi had never been in jail before.

Sometimes he types and sometimes somebody else does.

C3- can't recall the trauma- amnesia.  There is no scientific test that proves if somebody has amnesia.  The dr. can not prove what Jodi is telling us is the truth. JM says we can't look at Jodi and see her crater, where we could go to the meteor and see it with our own eyes

They came back after a long wait, then Palin asked for an approach.

Dr. is back on the stand. JM is still up for cross.
C1- Avoid and numb- The Dr. is saying Jodi lied to avoid feelings (the dr. says it's not a lie)
Dr does remember Jodi sending flowers to Travis' family. The dr. said Jodi was in pain.
Why else would she send flowers if she wasn't thinking about Travis being dead? Yes, in that sense.
The dr admits Jodi went on tv and thought about her feelings of the killing.
JM calls the dr. selective. The dr. says the trauma doesn't matter.

The dr. says he doesn't see it that way (about trauma) and JM yells out "of course not, you have feelings for the defendant" and dr. yells out "I do not, sir"

Dr. said that conversation was Jodi's way of dealing with the trauma.

The "trauma" was killing Travis. Her brain was helping her avoid it.
The dr. said he read the diaries. She talks about Travis for the same exact reason-Trauma.
Memorial Service- It was Jodi dealing with trauma is what the dr. says again.
Now your adding responsiblity to this? I may have misspoke.
All this is based on what she told you? Yes
If Jodi went to the house on the way to the memorial service, with Aaron Mortseoson- was she still avoiding? Yes

JM says-the trauma doesn't look at the responsiblity of the person/trauma? Yes
The dr says if Jodi was talking about Travis in good terms, that was her way of dealing with the trauma.

Jodi called Travis answering machine after the killing. The dr. says that helped her deal with the trauma. She also sent an email after he was dead. Dr. says the same answer. She also sent text messages after the killing. All because of trauma. (I think JM is showing the dr. is pull of BS)
JM says Jodi said she was trying to stage a scene (BOOM)

Jury has to  disreguard the last question. JM called the dr. a wordsmith. I guess Jodi's PTSD was different that other people's PTSD.

EX 275- text message. The dr. has to read it. (He is taking a page from the defense book and he is reading very, very slow)

Fight or flight- The first thing that happens is flight, then it it's trapped it will fight. Once the fight with animals is over with-that ends the fight. Dr says yes. Animals are done and move on.

Could it be sir, in this case, you are not objective anymore and it colored your view?  Now he is trying to explain how well he is trained. I'm neutral

The dr. admits he is a compassionate person.
Did your compassion enter into this case? Empathy entered this case. But I am trained to do my work.
Isn't good record keeping also important? I admitted a made a few mistakes. The dr. says he scored the test right to come up with PTSD. Doesn't matter that he came up with 3 different numbers.

JM says he failed with being accurate.
Isn't it true you lost your objectivitve with this case? Absoutley not.

Suicide- She expressed depression in her diaries. After June 4-Jodi didn't have a plan, but she planned to kill herself (uh huh) The state objects

Jodi was taking meds for sleep for 8 mths.  Jodi had trouble sleeping. Palin is saying the clip was just the tail end of the clip. The dr. didn't get to review the clip. (palin's a little bitchy today)

PTSD- The dr. says the numbers make no difference. He says they don't count.
EX 550-The score. The only thing that matters is the checkboxes the person checks.

5. What the differenece between coverup and alternative reality? They are different b/c of the brain and tauma

Alternative reality keeps them from feeling the trauma.
If the stress removed on June 5th, why does she keep protecting herself? The stress is not gone.

The dr. says Jodi is still in conflict.

Jodi felt like a weight was gone off her shoulders after she told.

Suicidal- The dr. would have taken action and alerted to people. The dr then explains what a person goes through in jail with isolation if they are on suicide watch. (I still bet it's better than being stabbed 29 times, having your throat cut open, and shot)

The dr. gives books out to his patients.

Did you gain knowledge in the area involving jail? No
Are you saying you didn't use the suicide, yes or no? I don't remember saying it.
(JM and Palin just got extremely snippy with each other. Claws are coming out)
The dr. is word playing about reporting patients at the jails for suicides. (uh oh, he walked into this)
Do you lack the knowledge to report a female patient? I don't know.
The dr doesn't even remember which jail she was at. (eye roll)

Yeah! I don't believe that for one second!
Everybody knows which jail Jodi is in. 
Books to patients- Self help book involve treatments? No, they involve self help.

Alternative reality and coverup- Coverup means not telling the truth, says JM. Both means the same.

Alice LaViolette is up. Palin is up. Alice does DV. She went 2 years at community college. Then she went to Cal State. She is licenced in Ca.  She does a lot of community org. She's been doing this stuff since 1979. (Sorry, I'm not mentioning much. She is just talking about all her good stuff and programs)

Her first trial was a homicide trial. She hopes she still has a private pratice when she gets back. LOL. She worked for def about 15 times, and the state about 9 times. She works with the DA in LA.
