Janeen Demarte is called to the stand. She list her education. She has lots of it. She has a PhD. She is actually a doc. I'm going to call her "Lady Doctor or LD"

The doc went to visit Jodi in jail. The doc knows Alyce would have been supervised when Alyce went to visit Jodi. The Doc would have supervised Alyce. (the doctor answers her questions in a clear, short manner) The doc is basically explaining how Doc. Fog was wrong in his whole approach. The doc explains how you should never come in to a case with an opinion already.
EX 456- Jodi's diary about "Nothing noteworthy to report"

Lady doc says she only reads the diary as face value. Lady doc doesn't read more into what is said.
Law of Attraction-the lady doc has heard of it. LOA is not part of the degree (LOL) Lady doc think the secret (the movie) caused problems with patients.

The lady doc was provided materials. Lady doc just picks out Jodi in the courtroom. Lady doc went to see Jodi. Lady doc considers 40 hours to be extreme. Lady doc has never heard of any doc talking to somebody for over 40 hours. Lady doc never apologized to Jodi. LD doesn't see the need to apologize to someone when she has to speak to them. LD thinks it's odd. Lady doc thinks it would make your results biased. LD was with Jodi 12 hours-and the LD says that was a lot of hours. The testing was separate. (I really like this lady doc. She's simple and uses simple terms)

Lady doc saw no need to go back and speak to Jodi. They only reason she would have if she was unsure about her opinion or new data. Lady doc never provides gifts ever. LD was provided with Doc Fog's notes. (Palin yells out it wasn't a gift)
LD has never provided anything to any patient. LD feels like a book may skew somebody's response to testing. LD also talked to Jodi about her sexual history.

Somebody named Sharon Carp. The report contained a test and reports on Jodi. Lady Doc read it. Ms. Carr said Jodi had PTSD b/c of abuse. Lady Doc compared Jodi's story, and they were very different reports. Jodi reported more abuse with Carp. Jodi told LD there were 4. Jodi told Doc Fog 4. Carp told "numerous" reports that LD couldn't even count.

LD did testing on Jodi. Some matched Ms. Carp's test. This test showed that Jodi had trauma, but the test doesn't tell what type of trauma. LD and Carp's test results were pretty close.

LD's test results are being marked. EX 620- test results. Jodi had depression. Not unusual since she was in jail. EX 620- TSI results-Jodi was uneasy about her sexual behavior. Depression and nightmares.
( fighting over calling Dr. Sameuls Doctor) Dr. Fog's test provided LD a bubble sheet. LD says she doesn't fill out the patients questionnaire. LD thought Jodi filled the bubble sheet out.

LD says that Jodi said a trigger of PTSD involved a stranger. (Lady doc is very good at explaining things) Lady Doc says b/c Jodi lied, it would void the whole test. PTSD is tied to a trauma.
Lady Doc just says this is just another example of Jodi lying. (BOOM...HAHAHAHAHAHA) (I hate to fan club somebody-but this witness is awesome IMO)

Approach Judge
LD is aware that the story has changed. Is the PTSD valid? It is not valid
LD says Jodi answered a different answer on a question which is turn makes the whole test invalid.
EX 550- Dr. Fog's test EX 535- The symptoms endorsed.
In your practice, once something is scored, is there a reason to go back and rescore? NO
Any reason why somebody would? If somebody was trying to change the data or rescored the test wrong.

MCMI by Dr Fog EX 541- Raw Data score sheet. Jodi's final score was 69. Next page is base rate scores. (Lady Doc is basically says Dr. Fog and Alyce were quacks.) (BTW, I haven't seen Jodi look at Lady Doc except one time when LD was picking Jodi out in the courtroom) Lady Doc doesn't see any need to ever rescore a test unless there is an error or somebody was lying.

EX 553- test results- Jodi's test (that Dr Fog gave her) was compared against people that had already had mental health issues. It would have been better to compare Jodi's test against the regular population.
LD says Alyce took a subjective approach to this case. There were no documents for LD to read. LD says there was no way to verify Alyce's report.
Palin objects-Approach (HLN is talking about a sir-rebuttal-UGH)
LD was provided with notes and an interview. LD says there is a big piece of missing data from Alyce-test. Alyce did no testing. LD knows there have been changing stories with Jodi and the events. It raises a red flag.
EX 600- Regan and Travis IM message on May 19, 2008- extremely afraid of Jodi. LD would never "go behind" words.
LD says the text message was a written word. It's data. It changes the data. Makes people look at it different. Palin objects

Approach
LD gave test to Jodi. She gave several test to Jodi to make sure she could read. She gave Jodi a smart test. IQ- Jodi preformed well on her short term memory test. Her processing speed and IQ was high.
EX 621-Jodi's IQ was 119. Verbal communication was scored as superior- the highest you can get.
MMPI test- it's a personality test that is used the most.

LD gave Jodi the answer sheet and document for her to fill out. LD puts it in a computer system, and she runs it twice.
LD did use the results of the test. "I cry all the time" shows depression in the scales/test. The 10 scales show 3 elevations. 7 of the scales were above 65 (threshold)
What does that mean to you? There was a lot of signs of mental issues. Psychopathology. The top 3 scales show aggressiveness. They are hostile, but they hide it well. They have violent outbursts. They like to blame.

The scales- "floating profiles" is when you see a number of elevations in the MCMI. It's common in BPD. (Borderline Personality Disorder)
Lady doc sensed that Jodi was immature b/c of the booking profile. Jodi told her parents she was happy as hell when they visited her in jail

Dr. Demarte's opinion of Jodi was BPD Level 2. Unstable, immature, constant change in personalities.
EX 622- copy of the DSM for BPD.
The first- Efforts to avoid real or imagined abandonment. LD thought Jodi had a huge desire to be attached to somebody. They engage in people to keep them close to them. They overstep boundaries. Jodi read his (Travis') text and emails. Jodi was spying on him.

The second-unstable or intense personal relationships- Jodi met the symptom. Jodi had a strong urge to go from boyfriend to boyfriend. She would idolize the men she was with. Her diaries are immature.
The third-Identity-Jodi would change her life to go with whatever boyfriend she was with. Jodi acted like Darryl's ex wife when she was with Darryl (OH shit) She dyed her hair and drove a certain car like OG's ex
The Fourth-impulse-do things on a whim. She didn't find this about Jodi

The fifth-Suicidal- LD says Jodi fits this because she talked about it a lot in her diary.
The sixth- Affective instability-- a roller coaster of emotions. Jodi meets this. Jodi went up and down as her ex boyfriends described her. LD seen that herself. The parents also describe this since Jodi was young

I guess I was just a little bit of a loss for words. And perhaps a little bit intimidated, not necessarily because of how angry you were, but because I wasn't sure how you would react to me trying to comfort you. I compare it to my own experiences, and I know that sometime, I don't want to hear it, I just want to yell and scream and vent (yes, I do on very rare occasions), and go through the motions until the situation plays itself out. Other times, I need comforting and to be told that everything is ok. I wasn't sure exactly what you were needing so I just listened, and as the conversation evolved, my heart filled with compassion for you.
However, you already know the Secret. I don't need to remind you. But you are so powerful, and you can turn this situation around at anytime. I found out, much to my regret, that my anger is very destructive. I've never beaten up anybody over it, but I have kicked holes in walls, kicked down doors, smashed windows, broken things. It hurts people (huge blank line), and it hurts me.It lowers my vibration and attracts unwanted lower-vibrational situations and people into my life. So I strive every day to "be the bigger person" and be a living example and Choose the Right and see everything through a filter of love. But it doesn't always work that way! I mess up. Sometimes I forget who I am. But I will never stop striving to be Christ-like as much as I possibly can.
This morning I woke up feeling awful. I called Darryl (only because I had to give him the phone number to our mortgage lender) and he said "hey, I was just going to call you. Any change in your situation?" And that's all he had to say. I lost it.....

Do you agree with Dr Fog and PTSD? I disagree. Jodi didn't display any of those symptoms.

LD says she disagreed with Dr. Fog. LD says she prepared a report in this case. LD does the typing and reviews. Any errors are her errors.
EX 544- Dr. Fog's report- PTSD- Lady Doc says it falls shorts in D and she would have to review C.
Why do you think this is not PTSD? LD is explaining the symptoms. LD says is Dr. Fog based his report on Jodi's lies, the report would be inaccurate. (I suspect she will be called on many cases after this)
PTSD can NOT be based on a made-up event. (Exactly!)
EX 545-symptoms. LD says that Jodi thought about the killing but not like a person with PTSD. Real PTSD has a very hard time moving day to day. Jodi told LD she had some dreams but not often. (I like how JM writes it down so it can go back to the jury room)

LD says Jodi didn't show any distress after the killing. She was going to the memorial and writing about Travis in her diary.
LD and JM are reading a lot of symptoms and such. Jodi wrote a lot of good things about Travis after the killing.
Pee Break
Jodi reported to LD that Jodi had a large gap in her memory. Several hours. LD says that is not how typical memory issues work. LD says that most people talk about it and gain some memory loss. Jodi reported to the LD that she went to go grab the knife. Jodi told Dr. Fog she disposed of the weapons and clothes.....but what concerned the LD was that she met with Jodi after the Dr. Fog and her story changed so quick.

Adjustment disorder-A change in behavior. (I guess the LD also said Jodi suffered for this but it was sustained)

LD has worked with people involved in abusive relationships. Uh oh, Lady doctor has experience with DV victims and worked with them. She still works in DV. She worked with both. Victim and preparatory.
EX 624- LD's CV or resume. LD also worked at a prison. She has experience with DV since 2003. She still works with them. She conducts 8-16 elevations a week about DV.
LD is now talking about BWS (Battered Women Syndrome)
LD thinks there was no abuse between Jodi and Travis. LD thinks Jodi lies. LD doesn't think Jodi was battered either. LD said that Jodi had no medical problems and Jodi liked her body.

(I think Palin is trying to say LD moved around from job to job) Palin is bringing up LD working with kids and CPS. LD says she felt some compassion for the kids.
Palin is going on and on about experience. There is no way I am writing all this experience stuff down. Palin is bringing up how Alyce was licenced in 1980.

LD never used the PTSD test. Palin keeps asking her times-UGH, she has already given the times. Palin just said uh, uh, uh, uh, uh at least five times.
Oh Palin is bitchy with LD right now. They were talking about PEDO, but then Palin goes back to work experience. uh, uh.
Palin needs to learn how degrees work. Now Palin moved on to research. Palin has a hard time knowing what research is. (this is boring)
